To ensure a smooth and enjoyable experience, we have set out the following terms and conditions. By booking a yacht charter with us, you agree to be bound by these terms and conditions, which apply to every client for all our yacht charters on our vessels. You agree to all the terms and conditions if not otherwise agreed elsewhere in written form. Please read them carefully before making a booking.

Terms and Conditions

1. Booking

1.1 Booking Process

1.1.1 Availability & Booking: To book a charter, please contact us to confirm availability and reserve your preferred date.

1.1.2 Invoice & Deposit: Upon confirmation, you will receive a formal invoice stating the deposit amount and the outstanding balance. The deposit is due immediately upon receipt of the invoice.

1.1.3 Charterer Identification & Contract Authorisation: The person making payment for the charter must be the same individual who signs the charter contract and is named on the invoice. Away Charters Global Pte. Ltd. will not accept payment from a third party on behalf of a Charterer who is not the signatory of the charter contract. By making payment and signing the charter contract, the Charterer confirms that they have personally authorised the booking and accepted these Terms and Conditions in full. Where the charter contract has not been signed by the Charterer prior to departure, Away Charters Global Pte. Ltd. reserves the right to deny boarding and cancel the charter without refund.

1.1.4 Payment Confirmation: After depositing, please inform us of your payment with a payment slip or similar confirmation. Upon receiving this payment into our accounts, we will immediately send you a booking confirmation.

1.1.5 Reservation Rights: We reserve the right to sell the charter to another party if the deposit or final balance is not received within the time stated on the invoice.

1.2 Charter Time Definition

1.2.1 Charter Period: Charter time begins and ends at the scheduled departure and return time stated on the booking confirmation or invoice. All boarding, safety briefings, travel to and from destinations, and disembarkation are included within the charter period.

1.2.2 Delays & Extensions: Delays caused by guest late arrival, weather conditions, sea conditions, marina congestion, or other operational factors do not extend the charter duration.

1.2.3 Early Arrival Advice: We strongly advise guests to arrive at the embarkation point at least 20 minutes before departure for day charters and 30 minutes before departure for overnight charters. This allows adequate time for transfers, boarding procedures, luggage handling, and safety briefings, all of which form part of the charter period.

1.2.4 Marina & Port Authority Registration: Certain departure locations require government passenger registration prior to departure. Where required, guests may be asked to provide a valid passport or government-issued ID and a photograph during the booking process. Failure to provide the requested information in advance may result in registration delays on the day of departure. Any time lost as a result of incomplete or late submission of guest information does not extend the charter period and no refund will be given for lost time.

1.3 Destination & Itinerary Disclaimer

1.3.1 Indicative Itineraries: Specific destinations or locations mentioned in itineraries, marketing materials, or guest communications are indicative only and are not guaranteed. Access to any location may be restricted by weather, sea state, park authority decisions, tides, vessel congestion, or safety considerations.

1.3.2 Route Discretion: The captain retains full discretion to modify the planned route to ensure the safety and wellbeing of all passengers and crew. See also Clauses 6.1–6.2.

1.4 Third-Party Services

1.4.1 Independent Providers: Any third-party services arranged on behalf of the Charterer — including but not limited to restaurants, beach clubs, water sports operators, transfers, national park authorities, or tour operators — are provided independently of Away Charters Global Pte. Ltd.

1.4.2 No Liability for Third-Party Services: Away Charters Global Pte. Ltd. accepts no responsibility for the acts, omissions, pricing, availability, or safety standards of such third-party providers. Any disputes or complaints regarding third-party services must be raised directly with the relevant provider.

1.5 Guest Fitness & Medical Responsibility

1.5.1 Health & Fitness: By participating in the charter, each guest confirms that they are in a suitable state of health to take part in boating, swimming, snorkelling, and related activities.

1.5.2 Personal Risk: Guests are responsible for accurately assessing their own physical condition and swimming ability before participating in any water-based activity. Participation is entirely at each guest's own risk.

1.5.3 Medical Disclosure: Guests are responsible for informing Away Charters Global Pte. Ltd. of any medical conditions, allergies, or physical limitations relevant to their participation in the charter. This may be done via the digital charter contract, booking communications, or during the onboard safety briefing. Away Charters Global Pte. Ltd. accepts no responsibility for consequences arising from a guest's failure to disclose such information.

1.5.4 Minors Supervision: Parents, guardians, and accompanying adults are fully responsible for supervising all minors in their care at all times whilst onboard and during all water-based activities. Away Charters Global Pte. Ltd. and its crew do not accept responsibility for the supervision of minors.

1.6 Personal Expenses & Cash Preparation

1.6.1 Personal Expenses: Guests are responsible for all personal expenses incurred during the charter, including but not limited to national park fees, onboard purchases, beverages, restaurant bills, beach club expenses, private transfers, longtail boat services, and any other third-party charges requested by the guest during the charter.

1.6.2 Cash Preparation: Away Charters Global Pte. Ltd. and its crew do not hold cash reserves onboard for guest use. Guests are responsible for ensuring they have sufficient funds available throughout the charter.

1.6.3 Emergency Assistance: In exceptional circumstances, and entirely at Away Charters Global Pte. Ltd.'s discretion, limited financial assistance may be arranged on a guest's behalf. Where such assistance is provided, a 15% administration fee will apply.

1.7 Food Preferences & Catering

1.7.1 Food Preferences: Where catering is included as part of the charter, guests are requested to submit food preferences, dietary requirements, and any known allergies via the online charter contract and no later than 4:00 pm on the day before departure. Where preferences are not received by this deadline, Away Charters Global Pte. Ltd. reserves the right to select a suitable menu at its discretion.

1.8 No Pets or Animals Onboard

1.8.1 No Pets or Animals Onboard: For hygiene, safety, and operational reasons, pets and animals of any kind are not permitted onboard any Away Charters Global Pte. Ltd. vessel. Guests are asked not to bring animals to the embarkation point. Any animal presented for boarding will be refused. Guests accompanying the animal may be required to remain ashore, and no refund will be given in such circumstances.

1.8.2 Service & Assistance Animals: Away Charters Global Pte. Ltd. recognises that some guests may travel with a registered service or assistance animal. Any such request must be made in writing at the time of booking and is subject to review and approval at the sole discretion of Away Charters Global Pte. Ltd. Approval is not guaranteed and will take into account the nature of the charter, vessel suitability, and the safety and comfort of all guests onboard. Where a service animal is approved, supporting documentation confirming its registration may be requested.

2. Altering a Booking

2.1 Minor vs Major Booking Changes

2.1.1 Minor alterations — such as guest name updates, changes to the number of guests, catering preferences, or departure time adjustments — may be accommodated at our discretion, free of charge, subject to operational feasibility, provided the request is made in writing at least 24 hours before the scheduled departure time. Requests received within 24 hours of departure will not be considered. All such requests are subject to availability.

2.1.2 Major alterations — including but not limited to changes to the charter date, vessel, duration, departure time, or overall itinerary — are generally treated as a cancellation of the original booking and a new booking. In such cases, the cancellation charges set out in Section 4 will apply to the original booking, and full payment terms will apply to the new booking.

2.1.3 The decision as to whether an alteration constitutes a minor or major change rests with Away Charters Global Pte. Ltd.

2.1.4 All booking alterations must be requested in writing via your relevant booking communication channel.

3. Payments

3.1 Payment Methods & Accepted Currencies

3.1.1 Approved Payment Methods: Payment is to be made using the methods approved by Away Charters Global Pte. Ltd. at the time of booking. Bank transfer is the preferred payment method. Payments are accepted in Thai Baht (THB), Euro (EUR), or US Dollars (USD), calculated using the Google exchange rate applicable on the invoice date.

3.1.2 Foreign Currency Cash: If paying in cash in USD or EUR, the exact amount must be tendered as we do not carry change in foreign currencies, nor will we provide change in any other currency, including Thai Baht (THB).

3.2 Service & Administration Fee

3.2.1 Service & Administration Fee: A service and administration fee of 5% applies to all bookings and will be shown as a separate line item on the invoice. This fee contributes towards operational, handling, payment processing, and currency conversion costs.

3.2.2 Cryptocurrency Payments: Payments made by cryptocurrency will incur an additional fee of 10% on top of the standard 5% administration fee, resulting in a total charge of 15%. This additional charge reflects the specific conversion and processing costs associated with cryptocurrency transactions.

3.4 Charterer's Responsibility for Full Receipt

3.4.1 Charterer's Responsibility: The Charterer is responsible for ensuring the full invoiced amount reaches our account by the applicable payment deadline. All bank charges, transaction fees, and conversion costs are the Charterer's responsibility.

3.5 Late or Non-Payment Consequences

3.5.1 Late Payment Cancellation: If the full balance is not received in our account by the stated deadline, Away Charters Global Pte. Ltd. reserves the right to cancel the charter, in which case any amounts already paid will not be refunded.

3.5.2 Late Payment Fee: Where the full balance is not received by the stated deadline and Away Charters Global Pte. Ltd. does not exercise its right to cancel the charter under Clause 3.5.1, a late payment fee of 10% will be added to the outstanding balance.

3.5.3 Denial of Boarding: We reserve the right to deny boarding to any guest or party whose balance has not been received in full by the stated payment deadline. In such cases, any amounts already paid will be forfeited in accordance with Clause 3.5.1.

4. Cancellations

4.1 Cancellation by the Guest

4.1.1 Written Notice Required: All cancellations must be made in writing via your booking communication channel. Verbal cancellations will not be accepted. The date on which the written cancellation notice is received by us shall be used for the purposes of calculating any applicable charges.

4.1.3 No Refund After Commencement: No refunds will be given if the charter is cancelled or abandoned by guests after the charter has commenced.

4.1.4 Discounted Charters: All discounted charters are strictly non-refundable, regardless of the reason for cancellation (unless we cancel the charter due to a departure ban officially declared by the Thai Marine Department, in which case a full refund will be provided).

4.2 Cancellation by Away Charters Global

4.2.1 Weather Cancellations: If weather conditions are deemed unsafe by the Thai Marine Department or by the captain's professional assessment, we reserve the right to cancel the charter. In such cases, we will first offer an alternative date. If no suitable alternative can be agreed upon, a full refund will be provided.

4.3 Late Arrival

4.3.1 Late Arrival Policy: If the Charterer or any member of their party arrives late to the embarkation point for any reason not attributable to Away Charters Global Pte. Ltd., the charter time will not be extended. The charter will conclude at the originally scheduled time, and no refunds or partial reimbursements will be given for time lost due to late arrival. See also Clause 1.2 (Charter Time Definition).

4.3.2 Destination & Itinerary Impact: Where a guest's late arrival reduces the available charter time, the captain may determine that the planned destination or itinerary can no longer be achieved within the remaining time. In such circumstances, Away Charters Global Pte. Ltd. will endeavour to provide a suitable alternative destination or experience based on the time available. No refund or price adjustment will be made in respect of any difference between the original and amended itinerary, as any such change is a direct consequence of the guest's late arrival.

5. Force Majeure

5.1 Force Majeure: No compensation will be paid in the case of unforeseeable and unusual circumstances beyond the control of Away Charters Global Pte. Ltd., the consequences of which could not have been avoided even if all due care had been exercised. Such circumstances include, but are not limited to: war or threat of war, riot, civil strife, industrial dispute, unavoidable technical problems with transport, closure or congestion of ports or airports, terrorist activity, natural or nuclear disaster, fire, pandemic, and adverse weather conditions.

6. Safety

Note: For guest health, fitness, and medical disclosure requirements — including the obligation to inform us of any medical conditions, allergies, or physical limitations — see Clause 1.5 (Guest Fitness & Medical Responsibility). For the no-pets and animals policy, see Clause 1.8 (No Pets or Animals Onboard).

6.1 Captain's Authority: We take the safety of all passengers and crew extremely seriously. The captain has full discretion to change the planned route at any time if, in their professional judgment, conditions are unsafe. In the event of a route change for safety reasons, no refund will be provided.

6.2 Itinerary Changes: All itineraries are indicative only and may be subject to change based on weather conditions, sea state, guest preferences, park authority decisions, or other unforeseen circumstances. See also Clause 1.3.

6.3 Crew Instructions: All passengers must follow the safety instructions issued by the professional crew at all times. Failure to comply with crew instructions may result in restrictions on activities, removal from certain areas of the vessel, or, where safety is compromised, termination of the charter without refund.

6.4 Intoxication: Away Charters Global Pte. Ltd.'s insurance does not cover passengers who are intoxicated. Guests who consume alcohol or any other intoxicating substance do so entirely at their own risk and may be denied participation in water activities or access to certain areas of the vessel for safety reasons. Where a guest's level of intoxication or behaviour is deemed by the captain to pose a risk to the safety of the guest, other passengers, crew, or the safe operation of the vessel, the captain may, at their sole discretion, require that guest to leave the vessel at a safe and appropriate location. Any costs associated with onward transport, accommodation, or other arrangements shall be the responsibility of the guest. In serious cases, Away Charters Global Pte. Ltd. reserves the right to terminate the charter immediately and without refund.

6.5 Guest-Supplied Alcohol: Guests may bring their own alcohol onboard in reasonable quantities for personal consumption. The captain and crew reserve the right to assess the quantity of alcohol brought onboard and, where amounts are considered excessive, to restrict what is permitted onboard or limit its consumption during the charter. Where excessive consumption is assessed to present a safety risk to any guest or crew member, the provisions of Clause 6.4 apply, including the possibility of activity restrictions or charter termination.

6.6 Guest Compliance: Away Charters Global Pte. Ltd. accepts no liability for any loss, injury, or damage arising from a guest acting contrary to the instructions or recommendations of the Away Charters Global team or crew.

6.7 Passenger Limits

6.7.1 Passenger Capacity: The maximum number of passengers permitted onboard any vessel is determined by that vessel's official operating licence. This limit cannot be exceeded under any circumstances, regardless of the type of charter or prior arrangement.

6.7.2 Boarding Refusal: We reserve the right to refuse boarding to any passenger in excess of the vessel's licenced capacity.

6.8 Illegal Substances: Illegal drugs, controlled substances, and any prohibited items are strictly forbidden onboard all Away Charters Global vessels. Away Charters Global Pte. Ltd. reserves the right to terminate the charter immediately without refund where illegal substances are discovered or reasonably suspected onboard. This policy is strictly enforced in accordance with the laws of the Kingdom of Thailand.

6.9 Photography, Filming & Drones: Guests wishing to operate drones, unmanned aerial vehicles, or professional filming equipment onboard or in the immediate vicinity of the vessel must obtain prior written or verbal approval from the captain before doing so, and must comply with all applicable laws, local regulations, and crew safety instructions. The captain reserves the right to prohibit or halt drone or filming operations at any time if deemed unsafe or legally non-compliant.

6.10 Guest Conduct Toward Crew & Staff: Abusive, threatening, discriminatory, violent, or inappropriate behaviour directed towards crew members, staff, or fellow guests will not be tolerated under any circumstances. The captain reserves the right to terminate the charter immediately and without refund where such behaviour occurs. Away Charters Global Pte. Ltd. reserves the right to report any such incident to the relevant authorities.

7. Liability & Insurance

7.1 Operational Compliance

7.1.1 Licences & Insurance: Away Charters Global Pte. Ltd. holds all licences, permits, and operational insurances required to conduct charter operations at the charter location.

7.2 Guest Conduct & Liability

7.2.1 Guest Conduct: Guests are responsible for their own actions and behaviour during the charter. Away Charters Global Pte. Ltd. accepts no liability for claims, losses, injuries, or damages arising from the actions or omissions of any guest.

7.2.2 Limitation of Liability: Away Charters Global Pte. Ltd. will not be liable for any losses, damages, or expenses arising from circumstances not caused by its own fault or negligence, including where a guest has chosen to proceed with an activity, action, or decision against the advice or recommendation of the captain or crew. In such cases, responsibility rests entirely with the guest. See also Clause 6.6. Nothing in this clause limits liability for death or personal injury arising from gross negligence by Away Charters Global Pte. Ltd. or its crew.

7.2.3 Personal Belongings: We accept no responsibility for the loss of or damage to any personal belongings — including electronics, cameras, and valuables — under any circumstances. Guests are advised to carry valuable electronics in waterproof containers and to ensure all valuables are covered by personal travel insurance.

7.2.4 Damage, Loss & Replacement: Guests are personally responsible for any damage to, loss of, or failure to return the vessel, its equipment, fixtures, fittings, rental items, or any third-party property or equipment during the charter. Settlement of all related costs is required before disembarkation in all circumstances.

7.2.4.1 Known Costs: Where the cost of repair or replacement is known at the time of the incident, the confirmed amount will be charged accordingly. Replacement costs shall be based on the reasonable cost of obtaining an equivalent item, including the most appropriate shipping method required to minimise operational disruption.

7.2.4.2 Unknown or Estimated Costs: Where costs cannot be immediately established, Away Charters Global Pte. Ltd. will charge a reasonable interim amount based on its best assessment at the time. Official repair or replacement quotations will be obtained and shared with the Charterer as soon as practicable. Where the amount paid exceeds the confirmed costs, the difference will be refunded. Where confirmed costs exceed the interim charge, the Charterer remains liable for the outstanding balance.

7.2.4.3 Payment Before Departure: Payment of all damage- or loss-related costs is required before disembarkation. Away Charters Global Pte. Ltd. will provide relevant supporting documentation to the Charterer upon request.

7.2.5 Experience Expectations: Yacht charters are outdoor marine experiences subject to natural conditions including weather, sea state, water clarity, marine life presence, and crowd levels at destinations. These conditions vary daily and are entirely beyond the control of Away Charters Global Pte. Ltd. Conditions that fall short of a guest's personal expectations do not constitute grounds for a complaint, refund, or partial reimbursement.

7.2.6 Personal Comfort & Marine Conditions: Sea sickness, motion discomfort, sensitivity to vessel movement, or any physical discomfort arising from weather or sea conditions does not constitute grounds for a refund or compensation. Where a guest or all guests wish to end the charter early for such reasons, the captain will make reasonable efforts to return to the marina or a suitable disembarkation point; however, no refund will be given for any unused portion of the charter time.

8. Holiday & Cancellation Insurance

8.1 Insurance Recommendation: We strongly recommend that all guests obtain comprehensive travel insurance at, or as close as possible to, the time of booking. Such insurance should ideally cover boating and watersports activities, emergency medical treatment, personal liability, trip cancellation, curtailment, and personal property.

8.1.1 Purchase Timing: Guests should be aware that insurers may decline claims where a policy was purchased after a known risk or event had already materialised. Delaying the purchase of insurance — for example, buying it only after adverse weather, travel disruptions, or other relevant events have already been reported — may invalidate a claim. Away Charters Global Pte. Ltd. accepts no responsibility for any guest's failure to obtain adequate or timely insurance cover.

9. Equipment Breakdown

9.1 Equipment Maintenance: While we take every precaution to maintain all systems and equipment, mechanical or equipment failures can occur on any vessel. Yachts operate in a demanding marine environment and are subject to continual use and normal wear and tear. Away Charters Global Pte. Ltd. undertakes regular maintenance and inspection programmes to minimise disruptions; however, unforeseen issues may occasionally arise. Our crew are trained and experienced in managing such situations and will take all reasonable steps to address them promptly.

9.2 Minor Issues: Minor equipment issues that do not materially affect the overall charter experience will not entitle the Charterer to a refund.

9.3 Significant Failures: Where a significant equipment failure materially affects the charter experience and cannot be remedied onboard, we will work with the affected guests to reach a fair resolution. This may include, at our sole discretion, a partial refund, a complimentary alternative arrangement, or another appropriate remedy proportionate to the impact on the charter. It does not automatically entitle the Charterer to a full refund.

9.4 Non-Delivery: Should we be unable to deliver the chartered vessel or a comparable alternative at the commencement of the charter — even through no fault of our own — a full refund will be provided. Where a charter has partially commenced and cannot be completed, a pro-rata refund will be calculated based on the proportion of the charter not delivered.

10

10. Complaints

10.1 Raising Complaints: Any complaint must be raised immediately with the captain or shore base during the charter. The captain or shore base will make every reasonable effort to resolve the issue. If the outcome is not satisfactory, the complaint must be submitted to Away Charters Global Pte. Ltd. in writing within 14 days of the end of the charter. For complaints relating to charters on third-party vessels booked through Away Charters Global Pte. Ltd. as an agent, the complaints procedure set out in Clause 15.2 applies.

10.2 Unraised Issues: Complaints that are not first raised with the captain or shore base during the charter will generally not be considered, as guests must provide Away Charters Global Pte. Ltd. with a reasonable opportunity to investigate and resolve issues during the charter period. If a problem cannot be resolved onboard, the Charterer should contact Away Charters Global Pte. Ltd. immediately on +66 61 234 5623.

10.3 Written Submission: All written complaints must be submitted by the Charterer personally, in writing via their booking communication channel.

10.4 Valid Complaints: If a complaint is found to be valid and fair upon review, the Charterer may be entitled to a partial or full reimbursement of the charter fee, at Away Charters Global Pte. Ltd.'s sole discretion.

11. Information Provided

11.1 Accuracy of Information: Information we provide regarding vessels, itineraries, crew, destinations, pricing, and all other charter details is believed to be accurate at the time of publication. We reserve the right to amend any of the above without prior notice as circumstances require.

11.2 Manifest Errors: Whilst Away Charters Global Pte. Ltd. takes every care to ensure that invoices, quotations, and pricing information are accurate, errors may occasionally occur. Where an invoice or quotation contains a manifest error — including but not limited to an obvious typographical or arithmetical mistake that results in a price which is materially inconsistent with the agreed or published charter rate — Away Charters Global Pte. Ltd. reserves the right to correct the error and reissue the invoice at the correct amount. In such cases, the Charterer will be notified promptly and given the opportunity to proceed at the corrected price or cancel the booking without penalty.

11.3 Digital & AI Content: Information provided via digital tools — including but not limited to artificial intelligence systems, chatbots, automated platforms, or third-party booking systems — is indicative and informational only. Only the formal invoice issued by Away Charters Global Pte. Ltd. constitutes a binding agreement. No liability will be accepted for errors, discrepancies, or miscommunications arising from AI-generated, automated, or third-party booking system content.

12. Price Changes & Promotions

12.1 Price Changes: We reserve the right to change prices at any time and to run promotional offers. The price stated on the invoice at the time of booking will be honoured for the duration of that charter. Promotions or discounts that arise after booking cannot be retrospectively applied to existing bookings.

12.2 Agent Charges: We are not responsible for any additional charges applied by third-party agents or intermediaries. Disputes regarding agent markups or surcharges must be resolved directly between the guest and the relevant agent.

12.3 Fuel & Government-Imposed Surcharges: Charter prices are based on fuel costs, port dues, park fees, taxes, and other government-imposed charges applicable at the time of booking. Where a material increase in such costs occurs after booking due to circumstances beyond our reasonable control, Away Charters Global Pte. Ltd. reserves the right to apply a corresponding surcharge. The Charterer will be notified in writing and supporting information will be provided upon request.

13. Intellectual Property & Privacy Policy

13.1 Intellectual Property: All content on the Away Charters Global Pte. Ltd. website — including text, product descriptions, images, logos, and video — is the property of the company and protected under applicable copyright law. Content may not be used, reproduced, or distributed without our prior written permission. As an exception, media assets (excluding text) may be shared or used by guests and agents for the sole purpose of promoting Away Charters Global Pte. Ltd.'s services, provided Away Charters Global Pte. Ltd. is clearly credited.

13.2 Media & Photography: All photographs, video footage, and other media created onboard our vessels during the charter may be used by Away Charters Global Pte. Ltd. for marketing, promotional, and social media purposes. We will endeavour to seek permission from guests before using images or footage in which they are identifiable, whether via the digital charter contract, booking communication channel, or onboard briefing. Guests who do not wish their personal likeness to be used should notify Away Charters Global Pte. Ltd. in writing prior to the charter date, or inform the crew at the start of the charter.

13.3 Data Protection: Away Charters Global Pte. Ltd. is committed to protecting guests' personal data. Data collected in connection with a booking will be used solely for the purpose of managing and fulfilling the charter and will not be disclosed to any third party except as necessary to perform the charter or as required by law.

14. Additional Terms

14.1 Complex Bookings Surcharge: Certain bookings require a significantly higher level of coordination than our standard one-to-one booking process — for example, weddings and corporate events involving multiple third-party vendors, or charters where communication is managed across a group of guests rather than a single point of contact. Where this is the case, a surcharge of up to 20% may apply to reflect the additional time, coordination, and resources required. Where applicable, this will be communicated to the Charterer at the time of booking confirmation.

15. Agency Bookings — Third-Party Vessel Charters

Important: If your charter is identified as a "Third-Party Operator Charter", additional operator-specific Terms and Conditions may apply. Please read this section carefully before confirming your booking.

Note: The provisions of this Section 15 apply only where Away Charters Global Pte. Ltd. acts as a booking agent for charter services on vessels not owned or operated by Away Charters Global Pte. Ltd. (i.e., vessels other than SY Amadeus, SY Shindig, SY Mozart, SY Nauti By Nature, MY Hot Chilli and MY Sail La Vie). For bookings on Away Charters Global's own vessels, the standard Terms and Conditions set out in Sections 1–14 apply in full.

15.1 Role as Agent: In agency bookings, Away Charters Global Pte. Ltd. acts solely as an intermediary between the Charterer and the vessel's owner or operator (the 'Operator'). The primary contractual and legal relationship for the provision of the charter service is between the Charterer and the Operator. The Operator's own terms and conditions will apply to the charter and will be made available to the Charterer upon request.

15.2 Complaints Procedure for Agency Bookings: All complaints must, in the first instance, be raised with the captain or shore base during the charter. If unresolved, the complaint should be directed in writing to Away Charters Global Pte. Ltd. as the booking intermediary. Away Charters Global Pte. Ltd. will use reasonable endeavours to assist in resolving the complaint and will liaise with the Operator on the Charterer's behalf.

15.3 Limitation of Away Charters Global's Authority: In agency bookings, charter funds are held by the Operator, not by Away Charters Global Pte. Ltd. Accordingly, Away Charters Global Pte. Ltd. does not have the authority to unilaterally authorise, process, or guarantee refunds or financial compensation on behalf of the Operator. Away Charters Global Pte. Ltd.'s ability to achieve a resolution is subject to the cooperation and decisions of the Operator.

15.4 No Liability as Agent: To the fullest extent permitted by applicable Thai law, Away Charters Global Pte. Ltd. accepts no liability for the acts, omissions, quality of service, safety standards, vessels, or decisions of third-party Operators. Away Charters Global Pte. Ltd.'s financial liability as a booking agent is limited to the amount of any booking or agency fees received by Away Charters Global Pte. Ltd. in connection with that specific charter.

15.5 Direct Communication with Operator: If we are unable to secure a satisfactory resolution on the Charterer's behalf, we will provide the Charterer with the Operator's direct contact details so that the Charterer may pursue the matter directly.

15.6 Operator T&Cs: The Terms and Conditions of individual third-party Operators can vary and change frequently. Guests booking third-party vessel charters through us are advised to request and carefully read the relevant Operator's T&Cs before confirming their booking.

15.7 Third-Party Operator Identification: Bookings falling under this section will be identified on the booking invoice or charter confirmation as a "Third-Party Operator Charter".

15.8 Conflict of Terms: Where the Operator's Terms and Conditions conflict with Sections 1–14 of these Terms and Conditions, the Operator's Terms and Conditions shall prevail in relation to the operation of the vessel and the delivery of the charter service.

15.9 Operator-Supplied Information & Media

15.9.1 Marketing Materials: Descriptions, photographs, specifications, videos, and other marketing materials relating to third-party operator vessels are provided by the relevant Operator and are believed to be accurate at the time supplied. However, vessels are subject to ongoing use, maintenance, upgrades, refits, and normal wear and tear. As a result, the condition, appearance, equipment, furnishings, or amenities onboard may differ from marketing materials previously supplied.

15.9.2 Accuracy Disclaimer: Away Charters Global Pte. Ltd. will make reasonable efforts to ensure information presented to guests is accurate and up to date, but cannot guarantee that all operator-supplied materials reflect the vessel's exact condition at the time of charter.

15.10 Vessel Standards & Quality Oversight

15.10.1 Vessel Review Process: Away Charters Global Pte. Ltd. regularly reviews vessels offered through its booking platform and may provide additional guidance regarding vessel condition, suitability, or service levels where appropriate.

16. Final Note

16.1 By booking with Away Charters Global Pte. Ltd., you agree to these Terms and Conditions in their entirety. Sections 1 to 14 apply in full to all charters on SY Amadeus, SY Shindig, SY Mozart, SY Nauti By Nature, MY Hot Chilli and MY Sail La Vie, for guests booking directly with us or through an agent.

16.2 For charters booked through Away Charters Global Pte. Ltd. as an agent on vessels other than those listed in Clause 16.1, Section 15 applies. In such cases, the relevant Operator's terms and conditions govern the vessel and its services. Sections 1–14 of these Terms and Conditions apply solely to Away Charters Global Pte. Ltd.'s booking administration (including payment, deposit, and cancellation terms as processed by Away Charters Global Pte. Ltd.) and do not extend to the Operator's vessel, crew, or service delivery.

16.3 Any deviation from these Terms and Conditions must be expressly agreed upon in writing by both parties. Verbal agreements hold no validity.

16.4 These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising shall be subject to the jurisdiction of the Thai courts.

16.5 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Appendix — Definitions

The following terms are used throughout these Terms and Conditions with the meanings set out below. Where a term is defined here, it carries that meaning in every clause in which it appears.

Charterer

The individual who makes the booking, is named on the invoice, makes payment, and signs the charter contract. These must all be the same person — Away Charters Global Pte. Ltd. will not accept payment from a third party acting on behalf of an unsigned or unidentified Charterer. The Charterer accepts these Terms and Conditions on behalf of themselves and all members of their party, and is responsible for ensuring all guests comply with these terms. See Clause 1.1.3.

Charter Period

The period from the scheduled departure time to the scheduled return time as stated on the booking invoice or confirmation. Boarding, briefings, travel to and from destinations, and disembarkation are all included within the Charter Period.

Guests

All passengers participating in the charter, including the Charterer.

Operator

In the context of Section 15 (Agency Bookings), the owner or operator of a third-party vessel on which a charter is booked through Away Charters Global Pte. Ltd. as a booking agent.

Shore Base

Away Charters Global Pte. Ltd.'s onshore team and operations base. Reachable during and immediately following a charter at +66 61 234 5623.

Departure Ban

An official order issued by the Thai Marine Department prohibiting vessel departures from a specified location or area.
